Dear all,
Myself and my husband both have approved I-797 for H1B from different US companies.
I went for my stamping to US embassy and they asked for more evidence regarding the US company and my case is currently pending with them with all my documents ( passport, I797, marriage certificate, etc).
Now my US company is not able to get a job letter for me.
Meanwhile my husband is planning to go for his stamping. He has good evidence to support his case.
My questions are -
1.) How can I retrieve all my documents from US embassy without affecting my passport and my H1 case?
2.) If I am able to retrieve all the documents safely, can I apply for H4 with my husband`s H1 stamping?
3.) Will they create problem for issuing H4 to me because of my pending H1b case?
4.) With H4 visa and I-797 approval notice, can I start working in US ?
5.) What will be the best way out of this situation without affecting our working visas ?
Please reply if you know anything.

I am Cross Charging and applying for AOS filing. While filing do I need to provide BONA FIDE copies of Marriage & Birth certifcates. ??
Its mentioned in the application right? You need to provide certified copies of marraige and birth certificates matching your application

If PD is current when USCIS starts processing the applications, PD's doesn't matter. But if PDs retrogate (which will be the case most likely), then USCIS only going to process the applications which has PD current that time. I hope it makes sense.

I am travelling to Penang on the 14th September, and I wonder how long it will take the consulate to process this visa application. Also, if I take the papers on a Friday morning, are they open for me to collect the visa on a Saturday ?

Applied for LCA before H - 1 B renewal and got the error "FEIN ID NOT FOUND " error. I submitted additional documents still waiting for reply from DOL. Applied for LCA on august 5 , got the reply "FEIN not found" on august 13, faxed additional documents on same day still did not hear back from DOL.. Pls advice how long it will take now???????

Yes, you can ask CIS to extend the RFE deadline and explain the circumstances. It is critical to make this request before the first deadline has passed.

I am nearing the five years on my H1B. My company (A) had it extended with my I-i40 approval. I want to know at this point is it okay to transfer h1B visa to another company (B)? I was told i can only get 9 month extensions with the transfer is that true? Also what if my company (A) cancels my GC process after transferring to company (B), do i have to go through the entire GC process again once I transfer to company (B)? I was told i only have to re apply the I-140 with the priority date given on the previous I-140?

One of my friend who is an accountant's H1 visa was sponsopred by a non-accounting firm who needed an accountant who is familiar with accounting pratices here is USA and India. Now that the firm who initially hired him and sponsored his visa doesn't have a full time accountant requirement and he is finding it difficult to find an accounting firm to sponsor his visa. But the firm who originally hired him is willing and has an opening to place him in an accounting firm as accountant. But since the firm who originally hired him is not an accounting firm is there any legal issue in doing so. If it is legal, what should the either of the firms and/or he should do as far as paperworks are concerned.

Would request any answers or any practical experiences in regards to my queries:
My wife and my infant daughter originally came to the US in 2004 on H4 and my wife got her H1-B also in 2004.
In Oct 2007 I and my wife got our EAD (The GC processing is through my company). Also since our arrival to the US in 2004 we did not go to India . But we are planning to go this summer.
My queries: We are planning to use AP to enter US

Every Tuesday, USCIS releases its data on the pace of usage of H-1B numbers. I'm monitoring that usage and projecting the end date for H-1B numbers. It's not complicated science, but I'm basically using a rolling average of the prior four weeks of H-1B usage to minimize the anomolies of one particular week and then assuming that usage over the prior month will continue at roughly the same pace. If usage picks up, the exhaustion date will be revised to be sooner and vice versa if usage declines. We actually saw a decline from prior weeks with 800 H-1B applications...

Hey.
Im new to photography and am looking into photography for local music venues.
I have a D40 with its standard 18-55mm lens but I'm looking for a lens with a better aperture.
I am looking to get the Nikon 55mm f1.8 which is around �80.
As this is not an AF-S lens and can not focus automatically, will it sitll work with the D40 if I use manual focus?
