    Senate Leaders Expect Immigration Bill Next Week

    WASHINGTON, May 11 � Senate leaders said today that they had broken a political stalemate and would bring to the floor next week an immigration bill that could put millions of illegals on the road to eventual American citizenship.

    An agreement reached today by Senators Bill Frist of Tennessee and Harry Reid of Nevada, the Republican majority and Democratic minority leaders, ends an impasse that has stalled action in the Senate for weeks while immigrants and their advocates have been holding huge demonstrations across the country.

    The deal does not mean that a bill will emerge from Congress soon. But it is significant that the Senate leaders agree to move forward, because the chamber operates under peculiar rules and traditions that can bury legislation indefinitely. Mr. Frist and Mr. Reid said they hope to schedule a vote before Memorial Day.

    Even if the Senate passes an immigration bill, it would have to be reconciled with a bill enacted in December by the House. That bill generally emphasizes border security rather than attainment of citizenship, so negotiations between Senate and House would probably be long and heated.

    "What the Democratic leader and I have laid out is a way to get on to this bill, and as you can tell, both of us are working in very good faith on the various issues that have been raised on the floor," Mr. Frist said.

    "I welcome the return of the immigration bill to the Senate floor," Mr. Reid said. "America's immigration system is broken, and our national security depends on Republicans and Democrats finding common ground to fix it. The assurances I have received from Senator Frist make me hopeful we can finally move forward on real comprehensive reform."

    The leaders' comments indicated that they had resolved the issue that had kept them apart: how many amendments to consider, and how much time to devote to them.

    "I didn't get everything that I wanted," said Mr. Reid, who blocked votes on amendments weeks ago, saying they were intended to gut the legislation. "I think the majority leader didn't get everything he wanted."

    Mr. Frist said there would be "a considerable number of amendments debated and voted on each day," and that they would be handled "in an efficient way."

    Until partisan bickering sidetracked legislation in the Senate in early April, the chamber was working on a package that offered opportunities for eventual citizenship, a guest worker program for some immigrants and measures to enhance border security. The tougher House ill focuses on border security and would crack down on illegal immigrants and those who employ them.

    Mr. Frist said 14 Republicans and 12 Democrats will negotiate with House members once the Senate passes an immigration bill. Seven of the Republicans and five of the Democrats will come from the Judiciary Committee, with the remaining negotiators to be picked by Mr. Frist and Mr. Reid.

    President Bush has said he favors legislation that would enable immigrants to become citizens, but only after they meet strict standards. He has said repeatedly that he does not favor "amnesty," a word that is anathema to many conservatives. "We congratulate the Senate on reaching agreement, and we look forward to passage of a bill prior to Memorial Day," Dana Perino, deputy White House press secretary, told The Associated Press.

    Senator Edward M. Kennedy, Democrat of Massachusetts, called the agreement announced today "a major step forward in our fight for tough but fair immigration reform."

    "Business and labor, Democrats and Republicans, religious leaders and the American people strongly support our plan to strengthen our borders, provide a path to earned citizenship for those undocumented workers who are here and put in place a realistic guest worker program for the future," Mr. Kennedy said.

    But quick passage is by no means assured, given the complexity of the immigration debate, the emotion it stirs and the approaching elections. Representative John A. Boehner of Ohio, leader of the House Republican majority, said in late April that he opposed the emerging Senate legislation and its emphasis on citizenship attainment. "I don't think that would be supported by the American people," he said.

    But the accord announced by Mr. Frist and Mr. Reid apparently means that immigration legislation will not sink out of sight in "the procedural quagmire that the Senate is," as Mr. Reid put it recently.

    These ppl are talking about giving amnesty to ILLEGALS...let me repeat it.. amnesty=award for being ILLEGAL. They have done that before and all of a sudden we F'KIN LEGAL TEMP WORKERS from India/China have to worry about the LEGAL aspect of filing a law-suit.

    Something is seriously screwed up with this. This is no different than a pseudo-SLAVERY. Now all of a sudden most of you will say, no one put a gun on your head to work. Ofcourse not, but why hell do they create a dual intent H1FU?K Visa where they show you the carrot and create a indentured servant system and discriminate on the basis of the country of your birth. It is discrimination. Trust me when there was SLAVERY in the US , it was defined LEGAL.


    It is dual intent meaning they will give you visa even if you intend to immigrate
    to US using either EB or Family Based categories. That is it.
    It never guarantees the GC. Therefore this lawsuit has no merit.

    A lot of people including my friends applied without having any clue about per country quota etc and believed they will get in 4 years.

    Oh, I trust the attorneys to file it correctly, I was just wondering if there was any way of finding out if it was received and processed correctly. With the H1B, 140, 485, etc. you get a receipt notice, but I wasn't sure if that was the case with the G28, probably not.

    The thought of the remote possibility of any correspondence from the USCIS going to the old attorney (for whatever reason), and not making it to me/new attorney in time to respond to it, is a little unnerving.

    Well, anyway, no point losing sleep over these things, although it is easier said than done.

    I agree. And this has happened. This happens NOT because new Attorney's G 28 did not get filed properly, it happens because VO may mix it up. Usually when a employer requests a revocation of 140 - in real - what the employer requests is "As this employee has left the company the prospects of his future employment with us is not there and we will not support this 140 petition in future. In other words an employer is telling INS "They will never hire you in future".
    So the VO does two things here. They send acknowledgment letters to the employer and their Attorney on file and send RFE/NOID to you and your Attorney. In this process some mix up might happen. Remember, a lot of VOs are very ignorant about AC21 and they may not follow the guidelines properly. Under the AC21 law it is clear that all you do is to change job to a same/similar position. As long as you follow law nothing must happen.

    Check your online status regularly - if you see LUDs call customer service - verify your address. If you do not get mail in 5 days - call again - if it is 15 days past call and ask them to fax it.

    Well, there are many folks here including me who filed around first week of june.. I haven't heard anyone getting the EAD yet. I haven't seen any lud's after the receipts. Hopefully, one more week to go and then we are all good to get the 2yr EAD....

    The problem here is not the immigration system it is sheer number of people who want to become permanent residents . The queues in Canada and Australia are far far far smaller so the point system works smoothly. The main disadvantage of the point based immigration system is that if the people in the line increase, the points will be immediately be increased so that fewer qualify .Then there will always be people like Lou Dobbs who will say that "potential immigrants will get points only if they make 240K a year and are 25 years of age". The UK is also restricting people by increasing the point based system. Now people who make 35,000 GBP a year do not get any points in the HSMP. The age also has been decreased in HSMP. So the point based system works where the queues are smaller unlike the US. The risks of point based system getting changed everyday are far larger than the US based system , which gives Green cards without any hard and fast numbers like salary , age and qualifications .

    Here is what i think ........USCIS works and approves according to RD till 140/485 approval. After this they hand over the case to DOS for visa issuance who work according to PD when allocating visa numbers. Correct me if i am wrong.

    So for a position classifed as a jobzone 4 and an svp between 7 <8, which of the following job requirements would be a better option for EB-2 filing:

    - MS+0 / No BS requirement
    - MS+0 / BS+5

    And by better I mean less chance of an audit or proof of business necessity requirements.

    I am afraid I am missing something. According to the worst case interpretation you can't require more than 2 years even for BS for zone IV.

    Can somebody remind me how BSs can still qualify for EB2? I heard this BS+5, but don't see how it can fit into zone IV and qualify for EB2

    It looks to me the only way for zone IV would be MS + 0.

    I am still puzzled why DOL accused me of having only 5 yrs of SVP on my first PERM. There I required MS+5 (stupid me - hoped to supply "business neccessity" later), which means 9. But they didn't say "you put 9" they said "you put 5" on the denial notice!

    Per 9089 instruction for Section H, item 5: "Do not duplicate the time requirements." So one would think experience is counted separately.

    Do they not follow their own rules?

    msgs like this help establish the notion that this is an indian website dedicated to indian immigration issues. I didnt see any post wishing happy Eid/ Eid Mubarak nor did I notice last year that anyone wished a Merry Christmas/ Happy Holidays, nor do we wish our Chinese friends a Happy Chinese New Year.

    The people who wants to be a part of American Society should first definately be a very open minded towards all cultures and social trends.
    Other thing to be Indian or representing Indian traditions is not a crime but certainly every time barking against anything Indian may certainly be a crime as it is a clear indication of closed door or prejudicial mind towards one particular country and culture. Americans do not mind if one shows that he is Indian now and want to become in American future. Although they prefer that AND that is why they label Jindal as Indian-American although he born in USA. If there are majority Indians on IV board, it is not a crime but it is obvious. Some of my chienese friends on IV board may start thread for wishing chienese festival, I bet most Indians on this board will welcome and same goes with Muslim friends on IV board. Starting and wishing EID MUBARAK thread (By the way that is also a Indian tradition..And I am proud of that too) is not a crime and by now if nobody started it does not mean other people may not welcome it. If you are a Muslim, start the thread for EID Mubarak, I will be the first to welcome that step. You want to be American,, right? Then first start learning open mind and start respecting the culture of majority IV memebers first. If you would not start that now how will you settle yourself in cultural pot of the world?

    If you are an Indian citizen right now take control over your inferiority complex and get over it because if you do not respect your culture or your tradition what guaranty would be there for Americans that you would respect American traditions in future. Even Americans are not fool. And how dare you pretend that people form China and other countries just stop supporting IV as they just see few threads celebrating Indian culture? So stop this bullshit now otherwise I may have to request moderators to ban you.

    Hi Guys,

    I am a July - 2007 filer and we got the FP request in July for me and my Spouse, I have not applied for any EAD or AP extensions recentlly, for a side note i have to travel out side US in July and my attorney requested for FP reschedule (which was actually scheduled in last week July) for atleast 6 to 8 weeks, but USCIS sent me the request with in a week with an FP date just 3 weeks apart from the original one..so i had to rush my things and had to come back to US to get the FP done..

    I just called TSC and got a helpful IO. He explained me that the FPs for my case are expired as those were done in Nov 2007. He issued a request to send another FP notice, not sure what help it will do at this time. He did tell me that my case is preadjudicated but also mentioned that preadjudication means nothing more than that a legal clerk or junior IO has reviewed the file and everything is order, in other words according to him preadjudication does not mean approval without any review.

    No matter whether you are in EB2 or EB3, if you lose job then you are going back to stone age. So we are all in the same boat. The only hope is to fix the leak.

    I see your point. But, that's completely different scenario.....job loss would hit the same way to each and every category, I guess.
    What we are talking here is to reduce the EB3I backlog atleast a little bit...may be a year or two behind EB2
    Take me for example.I have been waiting for 6 years now...just because of a stupid decision I made at that time to go with EB3 instead of EB2. ( just FYI, like many other EB3 guys, I am very much eligible to apply in EB2 ) I am paying the price now::((( Ofcourse who would have dreamt in 2003 that it would be so bad....and it hurts to see people who have applied at later stages cruise by while we wait watchig the VISA bulletins month after month..and now when I want to port the econom is so bad...everyone is being audited....so dropped that idea as well

    Are they not supposed to make sure that they have enough senators on their side to pass this bill. Whatever we have won till this point is due to the efforts of core team and people who come to this website using media/campaigns. I have not seen results of any lobbying efforts by this lobbying firm. Am I wrong somewhere ?

    Indian American contributing $5 million to Hilary clinton. THey have already collected $1million in short span of time. How about organizing Sharukh and Amithab to perform a show for IV in major cities like NY/NJ/Chicago and SFO. If anyone has contacts with organisers of these events, we can try to do something.
