I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.
I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.

Please note that the Form I140 is no longer valid for porting purpose under section 106� of AC21 if the I140 was revoked due to the fact that you did not meet the minimum requirements for the labor certificate at the time of filing. Due to the fact that beneficiary of the For I140 was found to be �unqualified� at the time of filing you are not eligible for relied under section 106� of AC21.

I hope 180 days had passed after 140 approval. A little more detail on the case will be appreciated. Was it a case of substituted labor?
First try to figure out what the previous company has done.
Get the help of your attorney ASAP. Figure out if there is a way to undo the damage.
I am not very sure of the details, a person I used to know was forced to join his previous company because they threatened him in similar lines.
& please do keep us informed along the way. We may be able to be of assistance to you in some way or the other. Local IV chapters have access to local Congressmen etc.
If nothing works go kick the ass of the person who is responsible for your predicament. Interpret kick ass to more severe alternatives. Some companies are anyway taking advantage of people stuck in GC queue. On top of that if they harm us they need to pay a heavy price.

I and many folks in this forum have seen very few approvals for this category. How come USCIS says that this category is over subscribing the visa quota. Why they are moving un used visas to EB2 (no offense) why not for EB3?

We all are working and in this economy everyone is worried about losing job if they don't go to work. I have two little kids and I work full time. I already used the vacation that I got for this year, it because of kids being sick one after the other and need to be off again next month for loss of pay for a kid's surgery. I know its just two more days and might result in something positive but I can't take a chance of losing my job and then don't have a job when it�s time for my 485 to be approved resulting in denial.
I will donate money but unfortunately, I can't come for the advocacy day. It is a sticky situation for many.
People who cannot attend personally...should contribute in other ways.

Same with me too. My application was moved from NSC to TSC and has been lying there since then. Hasn't been assigned to an officer yet:mad:
I never had any RFE, but my case has been bounced around for no reason. From TSC->CSC->TSC and I am told that it is not even pre-adjudicated not even assigned to any officer as yet. I have yet to see any more illogical organization other than USCIS. :mad:

My views:
I have not heard of any case, where they rejected an application because the "payable to" name was an issue.
We need an expert who knows how check processing works between 2 physical people, in our case, we people and USCIS and then later between the 2 banks, in our case, our banks and USCIS's bank.
Another example: My company accepts checks under a full name and also if paid using an abbreviated name. But thats because we have told our bank to accept such checks.
USCIS must have also done the same thing, they must have informed their banks too. All they are trying to do is TRAIN all people in the US, to write checks to only 1 name which is "US department of homeland security", because thats their umbrella organisation. It will take people some time to learn about the new change. But they wont reject applications because of that, unless there is a big difference. I am sure they will accept checks if you say "USCIS" or its full form. Money is going, finally, to the same place.
Most important bottom line : If they plan to reject applications if check names were not accurate, they are legally supposed to write that in the instructions that they will do so. If they themselves are confused they will issue an RFE or something and request you to send a proper check.
THEY SIMPLY WONT REJECT.
LAWYERS are SIMPLY WAITING FOR SUCH THINGS TO HAPPEN.
So people stop panicking. Dont worry.
Give your self 1-2 weeks and keep checking bank and call USCIS.

sounds funny and will make news, but I am not sure it helps in our campaign to get the system fixed.
It would get attention and help in educating (legal vs illegal) and would be done in conjunction with other things like:
-sending more flowers
-a huge rally in Silicon Valley
-candlelight vigil at congress
-mass letter mailings from all of us
-human chains
-hunger strike?
-etc
We have to attack simultaneusly (but SMARTLY) from all angles in order to be effective!

See we dont know what you wrote, so without that you might find people that find it offensive, simply because they have no idea what you just said.
It is like you going out with friends and one of them doesn not speak your language, so wouldnt you speak English to make sure he or she isnt left out and feels uncomfortable?

I recently applied (08/30) for advance parole as a new application (not renewal) at TSC, will I get a finger printing appointment from USCIS. The last update on my application was on 09/13 and no updates after that. I have travel in december I wanted to know how I can create an service request or Infopass? Thanks in advance.

Like I said earlier I pretty much feel the same way as you do. I want my spouse to be able to work for a couple of years before I think of moving back to India. But in reality having waited so many years do you think either you or myself will move back 2 years after getting the GC? Don't you think you will be tempted to wait 3 more years get the US citizenship and then move back? I have a few friends who are pretty much just waiting to get citizenship to move back. their argument is that we waited several years to get a GC and we don't want to just throw it away.
As for making H1B more humane I think it will never happen.
Most H1B holders get very good offers when they move back to their home countris after say 10 years. But the H4 spouse who spent al these years rotting in the USA again have to continue rotting....Their prospects are dim. So I want to get my GC. Let my spouse work here for couple of years and move back to my Own country.
So why not H1b made more HUMANE ?;) ;) ;)
