Hello Friends,
I am in 7th yr of my H1B and I have got 3 yrs extension on my H1B after
completing my 6 yrs. I have got my labour appliation and I-140 approved 1 year back and filed my I-485 in MAR'2005. My PD is Jan 2002, India EB3.
In SEP'2005, I got married and my spouse came to this country on H4 Visa.
Because of retrogresion.I couldn't file I-485 for my wife. Now I am waiting for my PD to get current to file 485 for my wife.
My question is, Can I change my employer by doing H1B Transfer. So that my
spouse wont be losing H4 Status. Also, when my PD becomes current can I ask my new employer to file 485 application for my spouse.
My lawyer has told me that filing Spouse's 485 has to be done with the same
employer who filed your application. Is it true? or Can I change my employer.

my friend's situation is like this
1) EB2 is approved through spouse and I-485 is pending ....priority date for this is March 2005
in the mean time EB1- 140 is approved.
so my question is
1) can i apply another 485 while the 1st 485 is pending... ?
2) should I go ahed and apply for new 485 with EB1 any suggestion's are welcome.

i have changed my status from F_2to F-1,
yeah you can go to canada, or mexico. even india, i went to india.
All they look for is funding, if your wife has funding from the university in which she got admission that is enough.

I filed my GC on EB2 and current status is :
I140 approved on Sep 2008
I 485 in process - submitted RFE on Sep 10th
Right now i m on H1B. I recently got married and my husband is on H1B he didnt start his GC process yet. At this stage can i add him on my green card. If so pls explain me the process ...

This is not really a revelation as visa fraud has been a problem for decades at US consulates around the world. But it reminds us that there are bad actors out there and US consular officials have a tough job in trying to make sure that deserving applicants get visas while they ferret out the fraudsters. The $500 anti-fraud fee that accompanies every H-1B petition is supposed to help provide the funding to properly investigate and root out fraud. It sounds like the system is working.

I filed my I485 on 31 July 2007.
I have not seen any action on my case. no checks encashed, no ead , no ap ...nothing.

I need to travel to India on 18 Oct, 2007. Can one suggest if it would be ok to travel or shall I postpone my tickets.It has been more than 2 months and I have not received the receipt number. How long shall I wait. I booked my tickets in July thinking that I will be able to travel in Oct :-(

Lots of activity to report. Congressional Hispanic Caucus leaders met this week with President Obama who said he wants a vote during the Lame Duck and would work the phones to round up votes. I have renewed my AP third time now; All three time AP went to lawyer; This time it was a record 15 days for AP approval. USCIS is getting it done superfast looks like.
EAD always came directly to me. (Never in DHL- probably a special case????)

Hi,
I have a question about H1B transfer. I joined a company A on h1b in may 2005 and did an H1B transfer on july 2006 to company B. Now INS has sent an RFE (for company B financial). I have submitted all the relevant documents when I joined company B for H1B transfer so my credentials are crystal clear. Now when the comhpany B sends a response to INS and if H1B does not get approved. Would I be able to do an H1B transfer to any other company. I spoke to one company they are saying that since the RFE is on the company's credibility so they can do an transfer provided if we submit all the paystubs which we got from company B. I have been working for a client and have all the recent paystubs. Please advice.

This reporter has got it right. The U.S. is obsessed with importing poverty from poor non-assimilated immigrants (mostly illegal) and shunning high-skilled immigrants who assimilate and increase the country's living standards. My I140 has recently approved on Aug,7th but the attorney and employer has already sent the withdraw letter to USCIS to cancel I-140 petition last month in July.But as they sent the cancellation letter to USCIS so is this possible if they sent the letter again to them not to withdraw or cancel I-140As right now I am in Canada,so I request them not to cancel I-140 and plz. do the consular processing for my case as I-140 is approved,so can someone advice me what will be the best thing,any advice will be appreciated.

My company is converting my L1B to a L1A.I wanted to know if i can apply for a green card independently after my L1A has bee approved or does my company needs to process that application.

All Employment Based green card has to be petitioned by the employer. So in your case, you would need to ask you employer to start the process. Only exception are people with "extrodinary ability" (the David Beckham's and Michael J Fox's) and people who fall under "National Interest Waiver" category (EB1 only - people who hold a Ph.D.).

G4 is not a dual intent visa. She won't able to travel till she gets her advanced parole, which could be long. She will also lose any home leave benefits she may have (if in the YP program). There could be income tax filing issues as well - check with your consultant.

You are fine. You can continue to work in US on the approved I-797. In US visa is required only to enter into United States. Once you cross the customs and walk into US that VISA is nothing. There after everything is I-94. with I797 you got new I-94 and that reflects your status.
