    Why don't we mail copies of our degree certificates, diplomas and other credentials? They will know who is more educated..Lou Dobbs or us !!!

    Same case was with me. They picked on my 3 year bachelor degree. Can i do appeal after 2 years ?

    Not appeal but rather re-filing as a fresh 140. The labor doesn't expire as long as you had filed an i-140 in the past when the labor was valid.

    I have applied for FOIA during Oct 2007. No response yet. Just checked the status. Thank you very much for the link. I did not know it existed earlier. Do you happen to know how I can change the address because I have moved ? I called the number they listed for FOIA on reciept notice. The asked me to call the regular USCIS number to update the address. The person who answered the regular USCIS customer service had no Idea about reciept notices starting with NRC. Any solution for this?

    You can request a copy of I-140 approval from USCIS using G-639 form (download from www.uscis.gov).

    In G-639 form, Fill out the following information

    I) Type of request
    -> Freedom of information Act (FOIA)

    2) Requester Information
    --> Your Communication address

    3) Consent to release information
    --> Please choose "A portion of my records" box

    4) Information needed to search for record
    --> Please specify only "ETA 9089" for PERM CASEs or ETA 750 PART A & B. ( I have asked for ETA 9089,)
    --> You can also ask for I-140 approval copy(Since i have approval letter i didn't ask.)
    *Note: If you specify portion of record in application, then it will be processed in Track one otherwise it is going to be in complex track(Track Two).

    5) Data needed on subject of record,
    --> Please give A#, Receipt number, DOB, I-94 Admission # and your name etc.,
    6) Verification of subject identity
    --> Notarized affidavity of identity
    7) Signature of subject of record

    8) Notary
    -> Please Notarized the G-639 form

    Send the filled form to the following address

    I have applied it, it is in the process, i believe it is going to take minimum 3 to 5 months since my case is assigned to Track One. Every month they are processing atleast 1000 Applications. It may take morethan 6 months if the case is assigned in complex track. If you ask for full package then difinitely they will put into complex track(ie Track Two).

    Please let me know if you need any more information on this regard.

    people applied in 2006 got their GCs. one of collegue ROW got when applied in 2007.

    dont know whom to blame. why cant they understand our problems.
    r they least bothered.

    My RD at NSC was 07/02/07 and my EAD status changed to "production ordered" just 5 days back(still dont know when I will get it). I think NSC is taking upto 5 months from RD to process the EADs.

    EB3 discrimination is quite blatant. Folks with a date of March 2004 should be automatically considered EB2 based on five year experience. This is not just for EB3-I or EB2-I but for all chargeabilities.

    That will require a change of law. Current law is based on qualification for the job, not that of candidate filling that job. If I am a PhD, but an employer needs a tool cleaner, which I am willing to accept, I'll be sponsored for whatever category the tool cleaner position falls in.

    If someone has gained 5 yrs experience waiting for on EB3, and wants to move to EB2, he/she will need to look for a job/sponsorship which requires 5 yrs experience. It is that simple. Lot of people do that...and retain their original PD. Isn't it a nice thing?

    looks like its more than 15 months since you gave ur finger prints..so I think they sent you to update their records..

    I think its only 1 time amnesty to all aliens who were present 5 years from date of enactment of this law, if it becomes a law.

    There is no big secret, except little bit of planning and starting something.
    I came here in 1997(at 22), but was in school for 2 years, started working in 1999. As soon as I started, I put money in 401k. I married early in 2000(I was only 25 then), my wife already did her M.S by then, she started working in 2000 even before our marriage. I made her put into her 401k(max out most of the time), we also put into esop. Together we have 300k in investment assests in 401k. Then I started a brokerage account and put 1500 every month, that accumualted to 150k now.
    I brought house early, as soon as I am out of PT, with in first year of H-1, it didn't appreciate much but I still have an equity of 200k in primary house(I took 15 year mortgage) and I brought another house, that I rent out which as an equity of 50k. I have some cash. I brought couple of plots in india and also constructing an house in my native town in India.
    But i want to do something else, I am happy with my life, for last two years, I got into golf, tennis and exercise, trying to be physically fit. I used to worry about GC before, not any more, whatever happens will happen.
    Except that I am not progressing ahead in my carreer, I want to do MBA and get into something else. Right now most of my money goes to day care for two of my kids around 24,000.
    More than money, you have to develop right habits, be healthy and have positive attitude.
    In my case, Secrets of my lifestyle are
    1. Getting started early, buying an house at 26. STarting 401k early.
    2. Marrying a girl, who is already working.
    3. Maxing my 401k and esop plan.

    Marrying a girl , who is already working??????????????
    If we are at this level of compromise, marry a millionaire's only daughter or a multi-millionaire's daughter (any number of kids) ;-) I'm sure you will find many.

    or mary a citizen.

    Date of issue : 10/18/2007
    Valid till also : 10/18/2007 instead of 10/18/2008

    How can I get correct the Valid till date ?

They closed this blog because the blog was getting filled with EB GC issues which are not of interest.     the reason i'm asking is this: when i applied my PD is current. how can 485/ead/ap not be processed, when i know that the date i applied it was current, though it retrogressed after i applied?

    Whatever you do, please do not go for CP. Because if the dates go back before the CP process is over, you will be stuck without work authorization card and I-131. Keep in mind that you will not be able to change job even after applying for CP. This is what I think. I am sure others on the forum will share with you more about the difference between CP and AOS.

    Hi,

    I am also in the same boat and waiting for the approval as I have recently took a new job with EAD. Yesterday I called USCIS to check what the options are if I don't get my EAD in 90 days. The customer service representative told me to take an info appointment further to get the Interim EAD. I have explained him that local offices are not giving Interim EADs and surprisingly he told me the following thing.

    "You can continue the work with I765 receipt notice provided your employer is OK to continue and told me to provide the receipt notice to the employer as a proof of your application is in pending. As I am surely aware of the fact that in order to continue the work we must have an approved physical EAD. I was totally surprised and asked him "Are you sure?? can we continue the work with the receipt??", he replied "Yes and only if your employer agrees for that!"

    I have no clue???? What to do, friends please share your thoughts on this.
