I just wanted to get this discussion back on track of ppl wanting to be able rise up a little, let their wives work and feel the freedom to make a decision to go back.
Let me restart the discussion. I know we are all frustrated to the extent that we want to pack up and leave but we have invested too much time to do that. But let's assume things start moving and we get our GC's in a year or so. Having spent so many years waiting to "settle" would you be willing to unsettle your life again and start over in a country that you left more than a decade ago.
Note that I am not doubting anyone's intention or disrespecting any entry. Just wondering if its the frustation talking or there are ppl who would actually leave?

Check ICICI. I think it is called a NRE account. You can fund it in Dollars and Rupees and it could be repatriated in Dollars. So just open the account and have them deposit the monies India, you can draw it here. This kind of account is for NRI's who earn an income in India and want to access it here.
There is a limit I think but it must be like $25K..

:confused:I am in same situtation. I want to reenter on AP and continue on H1-B. Can I do that? My company says its their policy that once I use AP to enter I will have to switch from H1-B to EAD. I dont want to do that. Can I still continue on H1-B?
I intend to travel to my home country I have H1 (not stamped but valid till 2010) working for the same sponsor if I use AP to enter US do I lose my H1 status.I have EAD but did not use it.

It all depends on the job requirements. MS+0 or BS+5 is considered as EB2. May be you can get a written statement from another well known attorney to help convince yours. Or you can try to use a different attorney if your employer permits.

I am into Datawarehousing and BI. Worked in multiple technology such as Oracle BI, Cognos, Informatica. It is frustrating to see my mid-size American Consulting Company charging the client a $180 per hour while I get $85K per annum. I cannot even switch to my client since I have signed a non-compete agreement..... I think direct marketing is the best way to augment your rates....
Well, I like you because you are just a straight shooter. If you are such a straight shooter then let me do some straight talk, so just catch this.
Your American mid-size company or Desi small size or super size company will get $180/hr but you will not get even $50/hr from the same client even when you go direct. So no matter how "highly-skilled" you think you are, your non-compete argument is not good enough for you not to be able directly market yourself, because there are gazillion other companies using BI, Cognos, BO, Informatica, Datastage and every similar crap. You can impress a few people by naming some technologies that maybe hot but they don't mean a &hit if you market them yourself. Here is why. A lot of people blame the lack of GC as a reason to be exploited. That is part of the problem. The other part of the problem is that most hiring managers in large companies get commission from these small, mid-size or large American, Desi or European consulting companies. That's why in most cases they always hire through one of these companies. They will not hire directly because the manager thinks you to be a stingy desi, and if he hires you directly the hiring manager will not see a dime, so why will he hire you directly? This is a big cycle of corruption and everybody is part of it including lawmakers who get contributions from lobbyist/representatives of these small, mid and large size companies. You think lawmakers don't know what is going on? You think client doesn't know that you make 85K when the middle company get $180/hr? You think the big-bosses at the company/client doesn't know that the hiring managers are getting favors from middle companies? You think lawmakers doesn't know that immigrant worker waiting for long delayed GC is bonded to an employer that buys employee retention insurance policy for the employer? They all know it. Dates for Eb2 india will touch early 2005. And dates will not move back from that point for rest of year. Of course it will move forward again in Aug 2009 bulletin.

I am probably waiting for the longest here for EAD, my app received on July 2nd at NCS. Called numerous times, sent form 7001, emailed senators twice, 3 infopass appointments, still no progress. I submitted expedite request based on humanitarian grounds last week, have been calling daily to check status of expedite and still remains pending. My case now pending about 157 days. Anything more that I need to do ?

I-140 - Not filed yet
I am about to file I-140 (PP) and I-485 concurrently beginning of June.
But looks like the the May 21st cut-off screws it up completely.
I have heard someone say that I might escape the new law if I get a Green Card before the law is enenforced on (10/1/2008). Does this assumption even hold any ground? Doesn't the proposed bill say that anyone who has filed I-140 after May 21st 2007 has to reapply regardless of where he is in the process.
Gurus please advice.

I appreciate your input, but IV members have been talking about numbers and numbers and numbers for last 2 years in a row.
What will the numbers reveal? I had been a regular blogger at IV, but I stopped coming up here because.
1. All talk and no Walk
2. New members come aboard, are rude and offer no pragmatic approach.
3. All these bloggers give ideas and critique each other.
4. What happened to the March1 09st rally in DC?
Why has IV not taken a pragmatic approach, don't take me wrong I respect what you have done and other approaches in the past. But IV is using same approach for a new problem, the end result-----Failure
I joined this community after july fiasco, and have kept close watch on dates, everyday members keep suggesting something or the other. I don't mind being a donor to IV or contributing little what I have, But I need to see some big movement and results.
I did all the stupid calling to congress senators
Did sending of letters to the White house
what was the result? If IV wants core members and new members to donate and be a part of something bigger than a website, then please initiate something big like a rally.
Just because their are less members to join, does not excuse a true purpose of a rally.
Some of core members of IV keep telling other members:
1. Join your local chapter
2. Be a donor,
I understand all this, but I as a visiting members and the people coming on here, want to see a true and real reason to be a part of IV and not just a website where immigrants come and breathe out their frusturations July Fiasco turned to be advantageous to a few members, but was a mistake for members like me and other members who could not file at that time.
Please prove me wrong and IV to be something more than a website, please initiate something big and real, and not just comments. I an aware of the achievements in the past, but it was past 3 years ago. For last three years immigrant's feelings have been played around too many times. Same old talks will not bring upon a change, SOMETHING BIG NEEDS TO BE DONE NOW BEFORE THE CIR BILL takes place. So people are more aware.
Show us IV core is more than words! Conduct something bigger that will attract new members and donors to this organization.
I as a professional can tell you all now--- passive movement, sending letters, long term planning with no actions will not help
