Let us say someone has changed employers after 180 days of 485 application and has no plans to invoke AC21(which is optional) .
1)What is the process to switch attorneys(from Attorney A to Attorney B)?
OR alternatively
2)If we don't want to choose a new attorney, but want all the communictation(such as RFE to come to you), What is the process ?
I read somewhere that you can do this by filing a new G-28, but not sure of the step by step process and the documentation needed.
Appreciate as much details as possible from someone who did this.

My father (over 60 years) is coming to the States in June 15, and his B1 visa expires on June 24. However, my father is planning to stay until August 20.
My question is:
Will he be able to stay after his visa expiration date?
In other words, when will his I-94 expire?

Once your father enters the US, the expiry of the visa does not matter. Your father will be able to stay in the US till the expiry of the I-94.
The expiry of the I-94 will be determined by the officer at the port of entry. Usually, for parents, it is granted for 6 months, but there is no hard and fast rule and it totally depends on the officer who is stamping the I-94. However, I think for B-1, the max. duration is usually six months (again - not 100% sure about this - it could be longer too).

Hello All,
I am currently in H1-B. My GC (EB2) is in progress sponsored by my company.
The I-40 is approved but me and my wife�s I-485 is still pending.
We both got our EADs, but we have never-ever used it. We just applied for it and kept the card.
My wife was also on H1-B through her own employment. She got laid off so she is losing her H1-B. Now I want to apply for her H4 as my dependant. Since she already has an EAD, will applying for H4 nullify the EAD? As I said earlier that she has never used her EAD however she plans to use it when she gets a new job.
Anybody in similar situation? Any remarks or suggestion would be greatly appreciated.

hi everyone
I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.
Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)
2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )
Any comments or suggestions will be appreciated.

If you don't intend to change your employer, you can travel on AP, comeback and continue working on H1B.

Pls. google USCIS pages for official info. You cannot stay for more than 6 months away from US each year every year. The situation might be different if its a US based company abroad.

You dont have to be employed by the employer for 180 days. All you need is 485 pending for 180 days. So in the letter you can mention that 485 had been pending for more than 180 days.
The only catch is if USCIS question about your "intention" at the time of filing 485. (Since you didnt work for the company after 485, and now specifically says dont intent to..).
At the time of filing 485 you should have proper intention to join the original employer.
Maybe somebody else who went through similar experience can help u.
AC21 invocation letters typically state that you're using AC21 for switching employment after 180 days. What argument should be used to invoke AC21 in my case?

Hi All,
My LC was approved recently(PD June 2004). The location/office for which my LC was initially filed was closed recently.
My company(which has offices all over states) has another locations/Offices in the same metropolitan area.The company attorney is saying that they can use my approved LC to file my I-140(and I-485 concurrently) for another location in the same area as long as it is within commuting distance of the original location.
Was wondering if anyone knows about this?

One of my family member came to US on visitor visa a year ago. She was granted 6 months visa at the port of entry. After 6 month, she filed for another B1/B2 extension with USCIS and was granted another 6 month of stay. The 6 month extension is about to expire.
She had booked her tickets and got ready to leave but unfortunately she became seriously ill and currently is not in a condition to travel. She is going through medical treatment but because of the seriousness of the illness, it might take another couple of months before she is healthy enough to travel.
Now the question is can she apply for 2nd extension of visa based on medical ground. By law, can she even file for a 2nd extension given that she has already been in the country for about 12 months. I talked to an attorney and he said that she can file but likelihood of getting another extension is very low.
If another B1/B2 extension is not possible, is there any other kind of visa available for her to stay here while she is going through the medical treatment?

I am one of those cases where no one can get my name right. This time my visa stamp has an FNU against my first name.
I have a valid SSN, valid California DL and a valid California marriage certificate. The I-797 is not a blanket petition. It has my name as I wish it to be. I used my I-797 to get my DL couple of years back.
The question is, will the FNU create any problems at the port of entry? Will it create problems when I renew my H1-B later this year?
How would I enter my name on the I-94? As on the petition or as on the visa?
