    Even in that case, all the benefits they were hoping to get from increased fees will be lost - and much more than that.

    Average fee hike is $500 but average reimbursement of expenses would be atleast $1000

    As per various lawyers' web-sites -- It is highly unlikely that there will be reimbursement of expenses even if case is won.

    Given that AOS drags on for 3-4 years, I would regard that not seeing your mum for 3-4 years in a row would qualify as an emergency.

    If you had a bad experience, please make it a point to file a complaint.

    Please do not take the abuse lying down.


    AFAIK, AP is considered only for emergency travel. That said, I think the officer was being over reactive.

    As we all know, immigration laws are arcane. AP for emergency travel was ok when people used to get GC within 6 months of 485 filing. Now, when it can take anywhere from 1 to 3 years to get GC after 485 filing, does it make sense to have AP for only emergency?! Crap...

    If the amnesty bill passes, you are better off pointing immigration violation and perhaps tearing you passport and claiming being illegal

    Before you tear up passport just remember that you were fingerprinted/ photoed multiple times before coming here and they can easily retrieve your records. Also if you change your names your degrees/experience will be worthless. Be careful while throwing out such comments.

    Is GC worth becoming illegal? If nothing works then leave it on fate and go back. India is not a worthless country. It gives huge oppurtunities. Sometimes I think that if westerners can go there and make money then there should be something wrong with me that I am so scared to go back.

    They have stopped issuing intrim EAD from local office.


    According to this from Murthy:

    Generally, one may apply for an interim EAD card, if the EAD application has been pending more than 90 days if there is not an unanswered Request for Evidence (RFE) on an I-140, I-485, or I-765 that is pending with the USCIS for the applicant. The interim EAD may be obtained at a local USCIS office. To obtain an interim EAD, two USCIS-specified photographs and the 485 and EAD receipt notices are needed.

    In my opinion if you choose to use EAD, I think you will be very much fine with this route but with H1 transfer it will be tricky. You may have to go through 2 H1 transfer to come up clean legally. First H1 transfer to new employer and second H1 transfer to old employer again As you did not work for old employer for one yerar and hence no pay stubs and hence technically H1 dies there and so if old employer is willing "to hire again after one year" your old employer should file new h1 transfer and then you can come clean.

    And during all this juggling make 2 things sure.

    - You do not get promotion
    - You do not get more than reasonable (10-20%) increment in the salary (The slary which was mentioned in your labor application)

    Again before juggling consult the lawyer first.
    I will be on EAD for the new job..and the LOA is vacation without pay. My salary is already 30% more than the one mentioned in labor but no promotions..new job has actually lower salary and job description similar.

    If i do ger rfe for evl with me in new job then I hope salary doesnot become an issue

    Getting Bernanke/media support will never be an alternative to IV efforts. They will, at best, complement it.

    I stand corrected that we still need to send letters and faxes to Senators and Bush. But a little push from the Fed won't hurt IV's efforts, would they?

    My son was born last month and applied for US passport. Once I get the passport I am planning to apply for PIO card in Texas. Can you please let me know if I need to send my son's original passport and the processing time. Can you please also let me know if anyone recently applied?

    Few things to add:
    3) To protect your familiy, think of the 3 areas: Death, disability and illness. Dying is the easy part...you die, your family gets a lump sum. The worst is that you DON'T die, but have a terminal illness (e.g. cancer), have no job and then incur substantial medical bills. Remember to cover all areas.

    everyone loves their money....but think if nothing will change how much of your loved money you will spend every year to renew EAD and AP...just do the calculations and you will think that it is worth to part some of our loved money..


    No offense Nik..but dude my company actually pays for it..so no loss..in renewing EAD..but unfortunatly my EAD is not yet approved..so I am not yet there.....SAD

    I dont think we need to waste our time about such non competent organizations , let them take the credit , it just shows that this was a great idea. Looking at their website it does look like they have some good contacts .

    I think immigration voice should write them a formal letter and ask them to publicise this to their "contacts" ..

    If they got themselves into this picture well,lets put them to work!

    The Ombudsman agrees with the assessment of many case workers and supervisors at USCIS field offices and service centers that the FBI name check process has limited value to public safety or national security, especially because in almost every case the applicant is in the United States during the name check process, living or working without restriction.

    The Ombudsman recommended in the 2006 Annual Report (at p. 25) that the FBI name check process be re-examined. Delays in the name check process actually prolong an individual’s presence in the United States while the check is pending. In this sense, the current USCIS name check policy may increase the risk to national security by extending the time a potential criminal or terrorist remains in the country.
    Name checks do not differentiate whether the individual has been in the United States for many years or a few days, is from and/or has traveled frequently to a country designated as a State Sponsor of Terrorism, or is a member of the U.S. military. Many individuals subject to lengthy name checks are either already green card holders or have been issued Employment Authorization Documents (EADs). These documents allow them to receive Social Security cards and state drivers’ licenses. Most green card applicants are also eligible to receive advance parole enabling them to travel outside the United States and return as long as their cases are pending, which can be for many years under the current process.     As Dawn Lurie, a Vienna immigration lawyer, put it: "If there's a security reason [for the delay], then what are those people still doing here? . . .     FBI name checks disclose information to USCIS that is otherwise not available. Information contained in 39 [percent] of the FBI positive responses (letterhead memoranda) received in FY 06 was not contained in IBIS/TECS, USCIS’ primary background check tool. . ..

    Use of the 39 percent positive response rate as referenced by USCIS to justify continuing this program may exaggerate the value of the FBI name check. It is unclear how many of the FBI name check “responses” also were revealed by one or more of the other security checks conducted for the applications. To date, the Ombudsman has been unable to ascertain from USCIS the total number of actual problem cases that the agency discovered exclusively as a result of the FBI name check. The Ombudsman understands that most, if not all, of the problem cases which would result in an eventual denial of benefits also can be revealed by the other more efficient, automated criminal and security checks that USCIS initiates.
