Thanks nrk. I am keeping my fingers crossed. I was current for two months in 2008 but did not get. So hoping for the best this time but again I would not be surprised if I don't get it, especially looking at USCIS/DOS works.

I don't think the threads on IV should only be related to GC retrogression. Yes, retrogression is the primary objective of IV. But, there are other threads on IV that are related to non-retrogression issues and, are very informative like threads on 401K etc. Anything related to immigrants should be welcomed.

Big corporations do a very good job in accommodating minorities and racial diversity. We had number of special classes to understand Indian culture when we started outsourcing. Some companies have diversity councils and they meet regularly to discuss issues or topics of interest.
I agree with some one's suggestion here that cosmopolitan cities are better than interior places where they don't see many people from other countries.
Many of my colleagues like Indian food but I will be selective in what I eat at my desk. As much as I like it, I Don't bring spicy Biryani to work.

Obviously i was wanting to know what the law states...and not a democratic answer. I dont always expect forums to quote the law correctly - use your judgement!

Now that if 140 is pending ...then I am left with EAD as the only option to continue manitaing my status.
Correct my intrepretation of law if wrong..
You can extend your H-1B. Why is EAD your only option?

Hello everyone,
1)Now a days AP renewal is taking 6 months
2) if you already have an Approved AP you can travel out of country with no issues.
3)if you are newly application AP for first time then you should wait until it is approved to go out of country
4) Even if you don�t have H1B stamping on the passport you can travel to you home country and come back on approved AP.
4.1) you can support your spouse also even after using AP (i.e H4 support)

If 140 is approved and dates are current most likely you will get one year extension...But sure you will get H1B extension.
I think its If pending...and labor approved 365 days before start date. I still need to check with my attorney. Also even if 140 is approved and dates are current i would not be able to extend.

Well, I don't think I am at the end of line of 300,000 people. There must be lots and lots of people whose priority date is after April 2004 might have filed. This includes 2004, 2005, 2006 and 2007.
So I think 3 years is intelligent guess. But who knows I am just trying to make myself happy and trying to stay positive.

I have been through this once. My company(a big one) lawyer said my position does not qualify for EB2. His main concern was salary was not enough. I got promoted to "Senior Software Engineer" and got into the required salary range. My labor and 140 were cleared. So my in my opinion salary range is also significant.

Schedule A group 2 is "exceptional ability" similar to the EB1 but with less stringent guidelines. You have to show international acclaim. I work for a non-profit that has international links.

So looks like only the renewal will have a delay. First-timers won't face much difficulties.
It might be a problem for those people working on EAD and waiting for renewal since they can't work if the renewal does not come in time. Why does USCIS not allow grace period for people to work based on receipt , the same way it does for H1b??

great work everyone. thank you nycgal and others that took initiative and pushed this effort further. committed members like all of you in this thread help us a lot by sending emails to reporters. several letters highlighting a particular issue generates interest in reporters and media orgs and they choose to write about us. It is not easy to get even a single article published in newspapers and it is due to the efforts of our members, we are able to generate awareness. There is still a long road ahead of us and I am sure with active participation from everyone, we will surely succeed.

Another important question is: Will USCIS allow AC21 without an approved EAD?
When you send all the relevant documents to invoke AC21, there is every possibility for the officer to check whether you have an approved EAD or not. In that case there might be a problem. I may not be correct. But to switch to a new employer, you definitely need a EAD card. I switched employers. My new employer asked for work permit(EAD in this case)
Note : Please check with your attorney, I'm just one like you and this is my experience

Thanks for the info. I went and pulled up the 9089 filing and just saw that the filing date was 15th may 2006, the expiry date was 3/31/2008 and hence i might have incorrectly assumed that the filing date was 2 years before that.

GO to Trenton DMV (theoritically every DMV), they will give you a DL till 6/20/2008. Due to these delays in H1b Extensions, NJ DMV's extending the DL another 90 days expecting that will suffice

This is the key stat here. It all depends on how many apps that are in the current category now get filed in the next few years. If there are no more new EB applicants, we should see all pending apps to get approved in a year or two max. The 4 current categories now are EB1 ROW, EB1 India/China and EB2 ROW. If there are 140K apps coming in every year from these categories, we'll never see any movement for EB2/EB3. Anybody know the average number of applicants the last few years from these categories? From the recent news, we know that demand for EB1 India and EB1 China has grown substantially. In my opinion, setting a cutoff date for EB1 India/China would be the best thing for USCIS to do now. That will prevent any new visa usage for EB1 India/China and allow EB2 and EB3 categories to catch up.
If they get continus apps from Eb1 in each quater how can they set up cutoff date ? ( I mean their demand with in range of supply ) .. isn't that illegal ?
