Big corporations do a very good job in accommodating minorities and racial diversity. We had number of special classes to understand Indian culture when we started outsourcing. Some companies have diversity councils and they meet regularly to discuss issues or topics of interest.
I agree with some one's suggestion here that cosmopolitan cities are better than interior places where they don't see many people from other countries.
Many of my colleagues like Indian food but I will be selective in what I eat at my desk. As much as I like it, I Don't bring spicy Biryani to work.

assuming you are serious about the house ..I can say this ..with your PD and category it makes more sense to rent a house for a year and then decide yourself.
with a house you get lot of space, independence but with significantly high costs, maintenance and loss of mobility. plus you end up buying far away from your work ..so family time is lost during weekdays.
in apartments - you end up saving and investing more in retirement accounts, children education accounts etc etc ..but the flexibility is priceless...also greater chance of your kids making more friends in apartment parks / play dates etc.
so renting a house is a good bet if you really really need space ....home prices will decline for many more months in most locations and will be stagnant for years when u take inflation into account ..

Sorry to hear about such cases. We all have to realize one thing here. The employers need us equally bad as we need them (more often than not, not talking about Indian consultancies here). If ever one encounters such racial discrimination and open abuse at the work place, the best recourse is to file a complaint with the higher ups in the HR, start searching for another employer and ditch the current racist employer at the right moment with an appropriate email sent to everyone detailing why the person is leaving at such an important phase of the product development. Yeah, this might sound un-ethical, but sometimes situations do demand such drastic measures to send the right message. That's when all these racist employers would realize the importance of the person that just left the company. Then they can try to fill in the position with their preferred race qualified person and see how difficult that gets!!
Better still, please talk to your friends and family in other parts of the US and find the areas in the US that are cosmopolitan and try to move to those places. Yeah that is very difficult in the short-term, but in the long-run, you would have peace of mind and a good quality of life after making such a move. Fortunately, i am in the Bay area and i have rarely encountered such racial prejudices out here. Just my two cents.

There is one more option for you. H1 and L1 employees can go on long paid/unpaid leaves. If her company can support with document that she was on an unpaid leave for any reason (I do not know the reasons...make something) then there are chances that she will be able to change her status back to H4. All you have to prove that there was a good faith employee employer relationship for that particular duration. Talk to a lawyer, explain the situation..........every passing day is making your situation worse. Good Luck.

Most clients have policies that require them to deal with only a preferred set of vendors. In some cases vendors are managed through a vendor management firm that classifies vendors into 3 categories. The highest level preferred vendors get the most billing rate per resource they provide. In addition, a vendor needs to satisfy a bunch of requirements like % of resources successfully placed vs the number sent for interview with the client, ability to have a certain $ amount of liability and workers comp insurance etc. Due to these factors, a client will not directly enter into a contract with an individual and that individual has to go through a preferred vendor. Now the individual (akak resource) could be tied to a lower level vendor who in turn sends him/her to the preferred vendor who then sends him/her to the client. One of the best ways to increase your hourly rate is to eliminate as many middle tiers as possible. Ideal situation is to work for the preferred vendor that places you onto the client. In most cases of preferred vendors this could only happen if you have a EAD/GC if they do not do H1s. A second best situation is to work for a Desi consultancy that works only with preferred vendors (aka only 1 level between Desi co. and Client). In these cases it might be possible to make almost as much hourly $ rate as you would make working for preferred vendor if say preferred vendor works 80-20 on Corp to Corp but works 70-30 on W2. e.g. Client pays vendor $100/hr, You work directly for Vendor on W-2 and Vendor pays you $70 (70-30 split on W-2). Now if you work for a decent Desi co. that works C2C with this Vendor and if the Vendor pays Desi co $80 (80-20 split on C2C) and Desi co takes out fixed $ (say $8-10) then you still get $70 in hand just like direct W-2 with Vendor. Oregon DMV is little lenient on this matter, but they see only the expiry date on Passport visa stamp. Oregon will issue license till one year after expiry date on the Visa stamped on passport in conjunction with the H1 extension approval notice. So all these original H1 extension approval will not be considered if passport visa stamp expired more than a year. We have to go to Vancouver, B.C to get visa stamped and come back.
California accepts the I-94 extensions in the H1 extension approval notices (That's 3 years back, but they keep on changing rules every month and the California DMV services are not fast enough). Also some times the information from USCIS will be hanging if you have extensions. But if you go out of country and come back with fresh I-94, the information is validated within 5 minutes electronically. DMV staff are more considerate in California.

The requirements for the position shouldn't exceed SVP time levels for the job zone to which the position code belongs - that's all I know. If the position code falls under zone IV or V you can require MS.
I still don't understand how BS+5 qualifies for EB2. If the position code falls is in zone V, BS+5 (7 years of SVP) would be a "normal" requirement, but isn't EB2 only for people with advanced degrees AND positions that require the advanced degree?

What if it is 3 + 3 ( 3 year Bsc Physics + 3 Year MCA) 10 + 2+3+3 = 18? I am wondering if USCIS would consider this equivalent to US masters? Came across a memo used by Nebraska Service center that says USCIS would consider 3+3 equivalent to US masters, but that memo was from 2006.

I guess country quota is root of all our green card related griefs. everybody else can dream of getting a green card someday, but EB-3/EB-2 India & China should stop dreaming about Green cards...I am sure this can be prooved illegal.

Another option would be to challenge the interpretation of the law. Like unused visa capture whether wasted visa

I would love to get involved with bunch of like minded people.....I have all the experience needed for starting and running a company. I have successully done thrice.....We have so many experienced folks who would love to start and run a company but lack the experience/knowledge of running one. it would be a good start to bring all such people to get together and pool our knowledge, skills, money and succeed.
Let me know what do u guys think... We can discuss next course of action.
