    I had anticipated this and actually converted my I-140 which was filed regular in Feb 2007 to Premium a few days after the June Bulletin and the fact that they terminated I-140 premium processing altogether for Labor Substitutions.

    We immediately converted our I-140 (in which we were recapturing our older PD), to premium to avoid any such future USCIS Bolts from the blue.

    WASHINGTON: Spelling tongue twister "cymotrichous", Greek for having wavy hair, Indian American Sukanya Roy has won the 2011 Scripps National Spelling Bee crown to retain the coveted honour for the community for the fourth year in a row.


    Roy, 14, an eighth-grader at Abington Heights Middle School, Pennsylvania, said she knew as soon as she heard "cymotrichous" that she'd get the word right and win the championship Thursday night.

    "My heart started pounding, I guess," she said. "I couldn't believe it. . It's just amazing. It's hard to put into words."

    It was Roy's third trip to the national spelling bee, and she had credited her past experience with keeping her calm and relaxed heading into the finals. She tied for 12th place in 2009 and 20th place in 2010.

    Roy speaks Bengali and every summer travels to India to visit family. She hopes to pursue a career in international relations.

    Roy is the ninth Indian-American in the last 13 years, a run that began when Nupur Lala captured the crown in 1999 and was later featured in the documentary "Spellbound."

    The winner will be awarded a $30,000 cash prize, a trophy, a $2,500 US savings bond, a complete reference library, a $5,000 scholarship and $2,600 in reference works and other prizes.

    Anamika Veeramani had scored a hat-trick for Indian-Americans in taking the crown last year.

    Roy was one of the six Indian Americans - Sriram Hathwar, Arvind Mahankali, Prakash Mishra, Mashad Arora, and Dhivya Senthil Murugan - who made it to the last 13 in the finals.

    The youngest finalist was 10-year-old Dhivya Murugan of Denver, who was born in India.

    The spelling bee kids just keep getting better and better. Even words like chlorthalidone," "dreikanter," "renminbi" and "helichrysum" couldn't sufficiently narrow down the field in the semifinals, which needed 95 minutes of overtime earlier Thursday to whittle the competitors from 41 to 13.

    The week began with 275 spellers. A written test Tuesday and two oral rounds Wednesday reduced the field for the semifinals.

    According to the Scripps Spelling Bee's website, this year brought contenders ranging in age from 8 to 15 years old from all over the world.

    - fill the complete i765 form, dont forget to sign
    - copy of 485 receipt
    - front and back of current EAD card
    - 2 photos (make sure to write A# and name at the back using a pencil)
    - check payable to US department of homeland security
    - file it correctly to the right service center (dont worry if the address is different than what u filed last time)
    - nothing else (since its a adjustment of status case, there is even NO need of i94)
    - Just make sure A numbers are written properly everywhere.

    My heart really goes out for Neelima and her family! I also faced this kind of situation in my office to a lesser extent.

    I am working as a permanent employee for a company and there are very few Asians working in this company. One of the business unit is outsourced to India and in our annual off-site meeting, the manager of that business unit sarcastically mentioned in the meeting infront of all the employees, how people in India lie about their resumes and how Indians are inefficient etc. etc. I felt so angry, sad and immediately walked out of the meeting.

    I have been a big fan of IV and have been a visitor to IV for a while. I now plan to become a volunteer and join my state chapter and also contribute in all possible ways to IV because I think IV is the best thing to happen to this community.

    Dear gurus - here is my issue and I need some real concrete help.

    I was working for a New Jersey based consulting company on a percentage basis ie 80/20 and all costs towards GC and h1b were by me. I found my own projects and negotiated my own billing rate.
    I worked for this company for 3 years and filed for 485 in July 2007. I am EB2 India with a priority date of March 2nd, 2006. My 140 was approved in June, 2006.
    In March, 2008 my project got over and I started looking for new projects. Market conditions forced me to take up a fulltime job using my EAD and I had to move into a fulltime job.
    As it is safe past 180 days, I used AC21 portability and moved.
    I had been having excellent relationship with my desi employer and in fact also payed up some money to the employer because the client did not pay for last 2 months of my project and my desi employer held me responsible as it was me who negotiated with the client and said it is my issue - for which I agreed.
    I already sent a AC21 letter to USCIS through my Attorney - I am not sure if my file got updated.
    My desi employer wants to withdraw the 140 petition now. He says, he cannot keep 140 petitions of employees who leave the organization and not on w2 and he will have "ability to pay issue"
    I have heard horror stories of USCIS issuing denials and NOID because AC21 letter never reached the file even though it was sent in time and I guess this is exactly what my desi employer thinks - teach lesson by withdrawing 140.
    I spoke to my Attorney and she says "your file may not be updated but we will keep a record that we sent" useful in case we want to respond to NOID or RFE.
    Folks - please post your AC21 success/horror stories when previous employer withdrew the 140 petition.
    What are my options to avoid a NOID or denial

    just becoz u'r kid is not good in spellings.... it doesn't make it mandatory for some folks to be jealous in demeaning way...... maybe you feel bad that a 10 year old has better english vocabulary than you at 40..... whatever it is.... u'r not always in competition with u'r surroundings........ grow up and appreciate the effort & dedication that breaks human limits..... even if it is a 10 or 12 yr old.....

    software can write software too...... then y do we need programmers.... y do we need eb2 and eb3?

    y do we have 100m race if we have cars? y do we have swimming contest if we have boats & ships that can go lot faster....

    have an appreciation for things around u..... just becoz u'r not good at something..... or just becoz u don't think its important to u..... it doesn't mean that it doesn't have any meaning...... there is lot more to this competition that meets the eye..... u'll value it only if you open u'r eyes and make an effort to see.....

    08/20/2008: Immigration Reauthorization Bills and Senate Needs a Political Push

    * There are four reauthorization legislative bills in the Congress. (1) Conrad 30 NIW bill , (2) Regional Center Pilot Investment bill (EB-5), (3) Nonministerial Religious Worker R-1 and Special Immigration bill, and (4) E-Verify Electronic Employment Authorization bill. The E-Verify reauthorization bill is very controversial adn currently facing a stong political opposition from political forces. The House passed the first three bills and forwarded to the Senate quite some time back, but as we reported on 08/02/2008, the Senate floor referred the bills to the Senate Judiciary at the last minute before the Senate left the Hill on August 2, 2008. These bills are currently presented to the Senate in two different formats: One is the format of the Senate's consent to each of these House bills separately. The other is Senator Specter's consolidated bill that put together all of these four bills into one bill. Obviously, Senator Specter's strategy must have been to tie the reauthorization bills to the controversial E-Verify Reauthorization bill. We reported that he apparently changed his mind and was pressuring the Senate Majority Leader to introduce E-Verify bill in the Senate first. Accordingly, it is unclear which strategies will work better to get these reauthorization bills passed in the Senate before they return to the election recess in early October.
    * The Senate is scheduled to return to the session on September 5, 2008, Friday, and to pick up the defense appropriation billl debates. The House is not scheduled to return to the session until September 8, 2008, Monday. Procedurally, unless each of the reauthorization bills is consented by the Senate floor without amendment, they will have to go to the conference committee or the House just consent to the Senate's amendment. The problem is the House bills were referred to the Senate Judiciary Committee just before the recess and unless a sufficient political pressure is added to the Judiciary Committee Chairman Lehey, they are destined to go nowhere when it comes to the time frame. On the other hand, Senator's consolidated bill faces its own problem because of the E-Verify reauthorization proposal. Besides, even if the Senate floor quickly takes up this consolidated bill, since it is a Senate bill, it will have to be presented to the House for their consent for the Senate versions. The question is how and when all of these actions will be taken up by the leaders of the Senate. The answer appears to be obvious. The relevant immigrant communities must recharge themselves and act quickly to add pressure on the Senate leaders to take up the bills quickly as soon as they return to the session. Probably it may be too late to attach these bills to the defense appropriation bill which they will pick up on the first day of their return to the Senate.

    They obtained authorization to file the lawsuit. They had it prepared to file and received good response from possible plaintiffs. It was possibility of good strong case by AILA that deterred USCIS to reverse the decision without a formal lawsuit. This is exactly what we need to further our cause. USCIS could care less about other petty tricks. They will only understand language of laws/court. For that we need congress to pass laws favoring us.

    All,
    My wife and I applied for EAD together almost 110 days back. My EAD came through within 60 days but no signs of any progress on my wife's EAD.
    Are more of you facing the same issue? We called USCIS and the officer expected another 3-4 month delay.

    What are our Options? I thought USCIS had a commitment to send out EADs within 90 days! Any idea why the interim EAD thing was dropped? Any exceptions under which they actually give interim EADs?

    What is your wife's situation, is it simple H4 to EAD? I have seen dependent EADs delayed if they are coming from F1.

    Look, the H1 quota was not sufficient even when it was set at 115,000 pre-2000. It was only when it was set to 195,000 in 2001 that the quota exceeded demand. Now thanks to the report by USCIS last year, we know that about 20% of the H applications had fraud or technical violations. Even if you assume that the USCIS does a perfect job and catches this 20%, the quota that will be freed up won't be enough for the rest of the applicants.

    The issues we face have less to do with fraud and more to do with the anti-immigration forces who dislike the 1965 immigration law. Claiming fraud, cheap labor, harm to the environment from increased population are just convenient means to couch opposition to permanent immigration in.

    actually pre 2000 the visa's were available all year long , then there was a crunch due to the y2K and then when the bubble burst it shrank again.

    when USCIS said 20% were fraudulent , they meant complete fraud like , people paid $$ bought in here as programmers and then worked in gas stations , driving cabs etc

    and again 20% was just taken from a sample space of about 260 or so

    if USCIS were to count every case where a body-shopper has a guy on bench with no pay , h1b procured when no project available that 20% will double up atleast.

    the Anti-immigrant lobby will always be present whatever year/century it is , its human nature , so that fight will always be there , in boom time or recession or whatever

    but this country is smarter in terms of dealing with anti-immigrants unlike UK and parts of europe where they completely cave in.

    True - that's exactly what the Adjudicating Officer told me today when I went in for the Interview :)......They want to avoid another July 2007.

    So, for efficiency, they are just pre-adjudicating some of the applications; so that, they don't get overwhelmed when dates move forward - they simply have to press the button for 'Card production ordered' message!

    In fact, the officer told me that he has 'approved' my application and will have to just wait for the dates to become current to get the actual plastic - also for fyi.....they can also deny the application instantly or request more evidence or call for a follow up interview. They actually give you a letter indicating what happened during the interview (it obviously doesn't say your application is approved - but it will explicitly say whether your application needs a follow up interview or additional evidence).





    Although officially so far, USCIS has not branded an I-485 status as "pre-adjudicated", if you haven't received any RFE and/or any other negative status about your 485, and if your case is outside the processing dates of the Service Center, then obviously dude your case is pre-adjudicated.

    I tend to believe that the offical status of being "pre-adjudicated" is coming soon. A few months back I read that USCIS is considering publishing another set of date known as "Qualifying Date" in their monthly visa bulletin. That date will define if you are "qualified" to file I-485. They will determine this date based on their workload. The idea behind is to avoid another July 2007 fiasco. They intend to process the 485's early rather than have you wait for your PD to become current. That way they will manage their workload efficiently and avoid visa wastage. They did indicate these applications to be pre-adjudicated then. I am guessing the official status of "pre-adjudicated" on your 485 application is coming soon.

    Bernanke's predecessor Alan Greenspan has written a book (check it on Amazon) where he makes a case for increased high-skilled immigration. He makes a forceful case that its good for the greater economy (and not just limited to housing sector). And yet, we don't see any action on the Capitol (do we?!).

    If Bernanke gives a media statement about the benefits of increased high-skilled immigration to media, it will create a few articles, a few heated discussions. It will peter out after that ( like Bill Gates testimonies to US Congress). Ultimately its the guys sitting in the Capitol and WH who control what becomes the law. And they aren't going to decide on immigration based on what Bernanke states in a brainstorming session.

    Here's the complex process - Someone has to write a bill, work on getting sponsors and co-sponsors, network with other Congressmen to support the bill. Get it through the bureacracy of the Sub-committee on Immigration in the Senate, get a filibuster proof majority of 60 senators to get it passed. Same has to be done in the House. Get it out of House immigration sub-committee. Get a majority vote in the House. In doing all this they shouldn't create a reason for Pres. Bush to veto it. In case he does veto it (for any reason) it will go back to Congress and 2/3rd majority is required to override the veto.

    If it was so easy to get a bill passed [by getting Mr. Bernanke to support it] lobbying business would've been long dead. Companies wouldn't be spending millions of dollars every year to safeguard their interests.

    Point is - getting Bernanke/media support may create a traction for our issue and get it some coverage. I'm not saying the effort is completely useless. It has it's place. But it will not fix the issue by itself. We still need to meet the lawmakers and convince them, we still need to send those letters, make those phone calls, send those faxes and so on. Getting Bernanke/media support will never be an alternative to IV efforts. They will, at best, complement it.



    Bernanke gets called often to talk about the economy and that gets Media attention (so even if he says everything should be done to increase demand and if he mentions immigration ..that would help) ..that is commonsense 101. it is definitely worth trying.

    ofcourse Ben may not read our letters but hopefully someone in his staff would (Approaching Ben or the realtors has more chance of success than sending mails to VP or to Bush) ...and maybe suggest the same during their brainstorming ..ofcourse all of this is hopes ..and with ifs and buts ..but I dont see lot of other options ..

    This was discussed before and I cannot find it now..but here is an extension of the degrees idea.

    1. Get everyone involved in the GC process to make a copy of their degrees/ qualifications/ certifications/ patents/ papers/ publications/ etc

    2. Format it into standard size (perhaps A4)

    3. Get a stamp on each of those sheets that says 'TRASH' or something else - maybe 'REVERSE BRAIN DRAIN' or 'KEEP TALENT IN THE US' - we can work that out. - it has to be bold, in RED, if possible across the page.

    4. Get each State Chapter to create a binder/ maybe more if we can get enough participation.

    5. We can submit a copy of that to local congressman and senators. We can also put all states together and send that to the White House, perhaps.

    This will take a lot of coordination from all state chapter...but it is doable.
    Any thoughts???

    Please don't shoot me down if you don't like it :) I just wanted to put my 2 cents in :p

    Recently I returned after a one month trip to India. At DC airport the CBP secondary inspection officer grilled us rough. First he called my wife and asked why did we leave US. She told that since my parents are old and not in good health we visited them. Then he started asking for documents proving it. And told us that without documents he won't let us enter. He went on to say that AP is only on humanitarian basis and unless CBP officer is satisfied with proof they cannot allow AP holder to enter. Finally after convincing him for another 30 min he let us in.
    This was a really shocking experience. Are employment based GC's AP supposed to be treated like humanitarian AP? or was the CBP officer over reacting? Gurus please throw some light.

    DSLStart, I am very sorry to hear your plight at the POE. I can exactly feel how bad and helpless we feel in that kind of situation. Glad you made it out of that situation...I just can make you feel better, I hope.

    I do not think there are good film institutes in India. I have interacted with many passouts from FTII and other colleges and found then lacking something. One has to travel outside India to learn and expose himself to the high quality film education.
    How many of the directors you have named received any film degree?
    I am not saying all Indian films are low standard compared to Hollywood films. We have trash films in Hollywood too. However the quality expectation and quality acceptance level of the viewers is low in India. Thus directors try not to push the boundaries so often.

    You cannot blame everyone on budget. Indian films have big budgets by Indian standards. You cannot convert their budgets in dollars and compare with Hollywood. In my experience , I have found that by and large people in creative professions in India are hesitant to push the envelope and try to do something 'safe'. Very few can think outside the box and those few are able to produce world class work.

    All this can change once viewers in India get more educated, critical and demanding. That will be the end of mediocrity and start of world class work.

    thats the problem.... I cannot switch to another job as I am in the 7th year of H1B and I-140 approved but did not apply for I-485 yet. friends told me its risky to switch jobs now as I may be out of status.
