    I don't agree with you.

    While we are waiting for GC,What options we have in US ? How to use our time more effectively instead of worrying too much ? This is what we were discussiing. It is indirectly related to immigration.

    Even if you are an immigrant but as long as you are subject to the law of UnitedStates you have every right to fight discrimination and other actions that you percieve are illegal. Even Illegal immigrants can do that. It is there in one of the ammendments.

    Well in that case you "may" get caught by IRS (if they audit ). But in case of wire transfer you can prove that the money came from India in which there would not be any tax liability.

    In one trip if you bring in 10K or less than customs has nothing to do with it and as far as IRS goes

    then your mother can gift you 12 K$ in a year and 12K$ your father can gift and that amount is considered as tax exempt, if you are married then same applies to your inlaws they can also give you total 24K$ (12 each)

    so the total comes out to be 48K and then this same thing can be done with your wife so in 1 year you can get 96K dollars as a gift from your parents and inlaws TAX EXEMPT

    Yes, I agree - my experience has been the same. The customer service representative insisted the receive date was whatever showed up in the online status, even though it was ~45 days after the receipt date printed on my receipt notice.

    Btw, I have a question about background/namecheck. I remember reading someplace (official) that fingerprints are valid for a period of 15 months. Now imagine this - at the end of that period, you are fingerprinted again, and while the background/namecheck is in progress the "annual lottery" period opens up in Jul/Aug/Sept. Is that file skipped again since background check is pending?
    Regardless of what laws USCIS vouches for, I believe this is what happened during last year "lottery season" in Aug/Sept. My background check was completed and entered in the system mid-Aug., while the USCIS ran out of visa numbers a week or two later.

    Thank you very much for all the response. I waited for responses from different places so I could determnine if it is a Nationwide policy as what the Colorado was saying.

    I am from Colorado and I think Colorado is one of the strickest states in the US whatever.

    It looks like from responses that only Colorado has so far adhered to this new policy.

    I have 4 friends who currently cannot drive because their licenses have expired and they are waiting for MVI's (Motor Vehicle Investigative Unit) letter. Until such letter is issued, you cannot renew your license (in Colorado). According to MVI Here, it will take to 5-7 days, but if there is a problem, it will take up to 9 weeks.

    Really rediculous procedure and I agree with everyone.

    Just in case anyone there is in the same predicament, please share your story and the resolution.

    Mainstream media seem to be cautious about these issues as it may work against their self interests.

    But if you're on travel and questioned by immigration upon entrance if you're still working for sponsoring employer, depending on the circumstances, they can take your GC away. So that's another scenario separate from an audit or citrizenship interview that GC jeopardy may arise.


    Didn't think about that. but... why would officer ask "do you work for the sponsoring employer"? Isn't your GC same as family based, asylum, etc. green cards? Does officer even have that information right away? What do they ask usually?



    If circumstances change, like you getting laid off or fired, that's a different story. If the sponsor's intent changes, and that does happen, then obviously, you're free to move on. But you should be able to prove that, with say a termination letter, for example.

    I don't see the difference between being laid off and leaving yourself. In case of being laid off, your employer has to show intent of employing you forever. If any document will surface, that he had plans to lay you off before applying for I-140 or without you invoking AC21 at moment of AOS, then you are in the same trouble.


    All the way one keeps thinking that you are free to start a business, look for more exciting opportunities, go work in starbacuks...( yeah all that )...once you get a GC..

    But, now everyone is talking about again sticking to the sponsoring employer, a green card being revoked while entry...and umpteen scenarios...

    So, where does it end..when can one really feel you can flex yourself and do something without worrying about my employment history...


    These issues are raised not to start freaking out, but just to know them and not to do some silly things.

    In general... take this philosophically - it never ends. If not immigration, then something else will always be. Just know the law, keep your paperwork in order, don't talk to government employees without a lawyer, flex your mind, and do your thing.

    I got a FP notice for next month. It is certainly not related to AP or EAD renewal, since I don't have any pending AP or EAD renewal. I got my EAD renewed last March and AP in May. So hoping that I got the FP notice since they started looking at my 485 application and something positive will be end result.

    Thanks Kumar1 for letting us know the options. We both have valid EAD's in hand. I like to maintain the H1B status as I am the primary applicant for the GC.
    As you said some of friends also mentioned the same about talking to lawyer. Only thing I expected in this time is peace of mind. This is the worst timing. We always wanted to welcome our baby with lots of joy and happiness. But this desi consultancy put me in this worst situation I never expected.

    Lets not hope for results just act. If Gandhi could drive Britishers out of India using this approach, USCIS is also made of human people and sure they will do something to lessen our pains.

    I seriously hope that the Director of the USCIS understands our "Gandhigiiri".

    Guys,
    Thats what my Question is......how i am gonna prove it i paid 3k for my H1. They are deducting 500 (for my H1) everymonth from my paycheck in the name of CASH ADVANCE DEDUCTION.
    I really want to teach them a lesson....so that they stop messing many vulenerable people like me who go to them every year. Could somebody tell me how i am gonna complain DOL in new jersey about this company and does DOL really takes any action.
    Greencard is not i am much looking for......i am planning to go back to india after 2-3 years.

    Well, in your case you don't have to prove anything, your employer has the burden to prove that he gave you "Cash Advance", which he didn't. He is the one deducting from your pay check. Deducting any amount from any pay check is a big deal and employers have the burden of proof. But that's the least of your worries. You are taking about "how will you prove". I am sure you can report this to US DOL and/or NJ dept of Labor. Given a choice, it would be better to report this to US DOL as foreign labor is in the jurisdiction of US DOL. If are willing to report your employer (whom I have many adjectives to describe), I will post the link to DOL website. In the past there were some post on this forum that said that the admin of this site could also help if you want to do something like this. Be ready to change your employer after you report to US DOL. You employer will be toast and will be debarred from filing H1s for few years (practically forever).

    Thats 24 DAYS!!! from the time NVC says it genertaed it, to us getting it.

    Sending the money order out today.

    Now lets see how long it takes to process that and then send me packet 3!?!?!

    Nothing. Just intent to work for sponsoring employer permanently. This intent can, however, change after 180 days of filing I-485 (if it is still pending). Important: This intent should not change until 180 days.

    Like what documents I need that time?
    New Employment Verification Letter from new current (or future) employer and letter to USCIS notifying that you are invoking AC-21.

    Do I need 140 copy that time too?
    Not Needed, but nice to have.

    If point sysem is introduced the big losers are immigration lawyers as they cannot make money in multiple stages. So no wonder if they oppose. Of course there is some limitations but its sucess depends on rules and regulations. Also there is going to be a Cap and there is going to be a provision to prevent displacement of US workers as the worldwide demand is always here. But main advantage is it will bring down the work load of various agencies like DOL and INS also employers.

    the reason it will never work is not the lawyers. the immig lawyers for the most part are honest people.

    the problem is the employers. employee's loss is employer's gain. it is simple enough. if the point based immigrant is allowed in with a EAD or a green card (like in canada/australia), the employers lose out big time.

    The only reason h1 exists is because employers want cheap labour. That is why they want more h1s. Because h1s are justified from business point of view, that is why it is illegal to charge the employee for the h1 costs.

    But they never talk about how the h1s get screwed.

    Because the h1s are screwed by them.
