I ran across this article in one of the websites and read through all the links. I think, there is a strong message in this case, something I have personally faced in the past and do still face at at a smaller level. Though it is not an attempt to help raise money for her. With 140,000 we have more candidates in the backlog and many more joining through Perm process.
If CIR is passed, many in the backlog will move to new merit system because their labor is still pending and no new GC application after May 21st 2007 also.
So, you have lot less people picthcing against 10% of 90,000 visas vs the case now where there are lot more people for 7% of 140K.
I still don't get why it is bad for everybody?
It is definitely little better for those who can use older GC process/system with 10% of 90K visa numbers.
Also, i bet there will be another amendment to add more to 90K for clearing the backlog much faster.

Good point though.. I agree with you.. This is coz.. the kids learn language by sound units not by word units.. They see their parents talk, often running words together to smoothen up a lil bit as a part of their speach music.. Kids follow.... and as they grow, if you ask them to put it in paper... damn!..they can't..

Even in India, I have seen.. there are people who speak for Example (Konkani), can't read or write Devnagari script But they speak well... so.. here you go.. "Sound units to Word units.." :)

Looking at the Labor cert , it says "Masters degree" and NOT "Masters or equalent". that might be the caused the I140 denial .

This is one of the most important bill for all our current chronic problems... once we get to solve these with this bill... we can focus futuristic goals as mentioned in IV list.... IV admin should make this an important thread and follow..encourage people to follow with congressmen and senators.

I don't think USCIS takes into consideration whether the MS is full time / Part time / distance learning. On the degree certificates no University mention's if the program was full time or online. Also i don't think USCIS goes by the reputation of university. As far as Accreditation is concerned please check with education evaluators they might be of help but then again I don't think USCIS looks for accredited programs. I say so because there are lot of local schools which are not accredited but have good reputations locally.

I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.
I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.

The only reason i feel this so called "family-bill" will not generate too much anti-immigrant sentiment is because it doesn't have the baggage of being termed the CIR bill.
The very mention of the word CIR stirs up strong responses and emotions from all parties involved.
This bill seems to tackle a smaller problem rather than going for a big bang solution that the CIR would attempt. That's why i felt it might have a better chance to succeed.

The main problem is that no one really knows for sure whether these steps are taken in sequence. There is little to no transparency. There are procedures, but we can not guarantee that they are followed.
To answer your second part. No, I don't believe there are any standard updates that indicate this, but I could be wrong. I think that there is an update if you clear it, but not if you are stuck in it. Make sense? I recently purchased 250K term-insurance policy for $11.66 per-month from NY Life. I'm 30 yrs old and qualified for their top-level health rate (eating right and exercise has financial benefits !). I guess they are the only good ones who sell policies to H1. Also, my policy has terminal illness coverage meaning that they'll pay out the amount in-case of terminal illness even if I'm not dead. I have another 100K coverage from employer (no cost). I'm not covering 10 times my current salary but I'm calculating by using equivalent Indian salary and not US. I consider myself amply covered. Also, my policy will remain active even if I decide not to wait for GC and move to India.
Now my 2 cents about Term vs. Whole Life debate. It doesn't make any sense to buy whole-life at young age. But since the cost of term maybe prohibitively high at 60+ one should convert to whole-life at some point unless one can find/buy a fixed rate policy till 80 or something (plan to die a little b4 that :D )

What do you mean by "too restrictive requirements"?? so do you think I will be better off finding another job with a different company so I can apply for a new PERM (EB2) or just wait for the appeal that is now over 6 months??
Also, I know that the reviewing officer is supposed to review my appeal request and send a copy to the appeal board so they can make a decision but he/she has not done that because I convinced the HR in my company to call the board of appeal and they said they haven't received my appeal request from the reviewing officer ( he was supposed to send it within 30 days). he has had my appeal request for over 6 months. I am not sure what to do at this stage. I feel like I am stuck.[/QUOTE]
This is how they sabotage it! By the rule you must send the appeal to the same office that denied your PERM. Then they must send the appeal file to BALCA (and a copy to the employer IMMEDIATELY), but they pretend they never received it from you, I guess. They violate the law, but I don't know if we can do anything. Assembly the appeal file yourself and write to BALCA that you did file the appeal with the center (you have a proof that the mail has delivered it, right?) but it was them who, in violation of the law, haven't forwarded it to BALCA yet. 6 months can not be considered IMMEDIATE under any circumstances.
