llc and s-corp are same for the situation you brought up... however, you gotta be mindful of the "corporate veil"... http://en.wikipedia.org/wiki/Piercing_the_corporate_veil trap... which can affect any company llc or corp... dont worry, there is nothing bad in it... just make sure that you keep real good records and separate business operations from personal...
further i doubt that s-corp or corp is a promotion over llc as your post seems to suggest...
anyway... your choice is not bad... and neither is mine...
disclaimer: many experts dont consider wikipedia a reliable source of information.
the low risk lies in the fact that any adverse decision you may have to take ever (God forbid) like bankruptcy does not affect your own personal credit history and assets. I am not sure whether the same exists for corp or not. So I may be wrong regarding the low risk factor of LLC. But I always had the notion of starting any venture as an LLC and then moving on to a corp.

This is not even good for long term due to hefty financial charges of insurance companies, you would not know about this until you buy one ,my sincere advice would be do not even get into this crap in US. these guys rip you off.
As I mentioned before Prudential charged 70% premiums as a finance charge every month and only 30% went to savings. It would never make sense and do n't listen to people who never owned these products before.

you will come acros these Jerks ..barely educated with BA music or Art degress or just some schooling and sitting as managers..what else can they do..abuse other people...prey on the weak..weak because we are on Visa...
they dont get any certification or any skills but however they want all the benefits/promotion..etc.
In such situation...dont let the situatuion grow..you need to change your gruop/company and remind the manager that they need to stick to rules..be diplomatic. If you are diplomatic and sensible in dealing with such cases..you will come out a winner..
Dont forget to complain to the HR about this person ...as this is a recurring pattern...then they will have a record of the persons behaviour
Yes, please do this. When I did it, I was not diplomatic and I believed people, but if you have some diplomacy, you can work it out for your own good.
As per my first post - the person though is an Indian, she is a US citizen. You all can now understand what kind of backlash is driving the politicians.
FArom all this we must understand that Grassroot advocacy is not going to be an easy task and there is a long way to go. More people, more funding, more support, more reach, more skills.

Also all said and done CIR still remains a controversial bill, that at the very least has to be debated at length in the house to send out the right signals. If it gets passed in the lame duck, the conservatives will go to town with their story that an amnesty has been shoved down the throats of the american middle class. I doubt either the president or the democrats want that at this stage.
because he has to regain his popularity with the American people, and immigration is not a top priority for the American people, as all the election polls showed, and as the infamous Ombudsman on this site "reported" so often

I don' think they should have been rude. However they do have a point. He should NOT have shown BOTH H1b visa and AP. You can enter on one or the other.
I have entered on AP previously and my experience was very good. Only thing is you have to undergo that "secondary inspection" process where they have to verify your pending status details.
When you hand them both, you might feel you are doing it in full disclosure,
however they perceive you are not clear in your intentions. When you show them your AP, their main verification is, whether this 485 case is still open and pending. With H1b they want to know if you are working for your visa petitioning employer.
The morale of the story is, if you have availed yourself of AC21 and moved into another job, you must use AP to reenter, either that or if you moved with a H1 transfer you can use that, however, presenting your old H1b is asking for trouble. H1b is employer specific. We always need to remember that. AP is not.
I intend to travel to my home country I have H1 (not stamped but valid till 2010) working for the same sponsor if I use AP to enter US do I lose my H1 status.I have EAD but did not use it.

kudos to what u accomplished in July 2007, but the reality is we haven't seen any major action after that. I guess its mostly frustration from ppl here, who think that the US housing/EB crisis can be pursued aggressively than expecting for CIR to happen.
thanks
Your suggestion to pursue this option gels really well with the below proposal
http://immigrationvoice.org/forum/showthread.php?t=23962&referrerid=15623
To quote realizeit:
"I believe the above proposal is a small step in the eyes of the protectionists where as it is a big leap for all retrogressed country applicants. We may be able to achieve this using administrative fix or an action from the Executing branch, as this won’t change the annual GC quota of 140000. Apart from this, this will encourage all those skilled immigrants to invest in American economy within 1-2 years of filing AOS application. At present most of us are sending our money to our home countries as our situation is so uncertain. This effort will definitely help the ailing economy and will serve as a boost to the housing market."

None of the Amitabh Bachans did any thing for slums,Danny Boyle Made a very good movie.I think the fact is Rehman is a prodigy no doubt about that, he makes very good music we all know that.As compared to Hollywood directors Bollywood directors are subpar with the exception of very few good ones. Movie business is controlled in India by few families, what ever the movies they make rest of the people will watch it.I dont want to open the bollywood can of worms.Movie directors in India are usually sons of Bollywood actors or some one related to Bollywood.
I am sure none of the Bollywood directors would ever be able to make good movies, they dont have a global outlook, neither the needed juice. usually Bollywood directors are some low key high school drop outs who have connections with mafia.
If some one who is reallly talented is not going to make it in Bollywood,Southern Film industry is even worse.

1. Recapture unused visas identified by USCIS Ombudsman
2. Remove spouse and children from the numerical limit
3. Either remove country wise (diversity) quota or increase it to some respectable limits that adheres to true representation based on population and the country’s immigration quotient.
4. What about automatic GC, say after 8 or 9 or 10 years in H1/L1 status?
5. Last of all, all the recaptured numbers should go to the persons based on the very first Port Of Entry date with continuous status. It doesn’t matter whether you came on F1 went to H1 then H4. The very first POE date should rule and people that have been languishing for years should get a reprieve. It’ll only be fair that a person that came on 1999 on whatever category gets a visa first than a late comer in 2005. PD is illogical since many of us had to change jobs and do what not and start afresh and still saw no light at the end of the tunnel.

I went thru TSC-EAC-TSC cycle. I did quite a bit of research online :) and found they did approve those cases, if PD is current. So, that shouldnt be a hurdle. Key is make sure you have all the checks are passed and current.
Well, there you go. Good news to sdrblr.

i'll break my word for one last piece of advice for my sensistive friend:
"The very reason why we join this forum so that we can, as whole, say something that may influence the law makers of this country to change the existing laws so that our problem with GC will be resolve."
no lawmaker is bothering to read this silly thread. Please stop dreaming. if you want to influence, go meet them! that remain's iv's official word on the matter too...see the meet the lawmaker campaign. and if you already have...you have my respect, you are too good in that case to waste your time complaining about this stuff.

Yes, Its the same number, but at one of the prompts, you need to put a different number for LIN.
I just call them, was told that they have no additional information that what is available on the recorded message or the USCIS case status web site. I said I wanted to know if the case is 'pre-adjudicated' and the lady mentioned that that information is not disclosed. ;(

I am planning to file EAD/AP for my wife who is on H4 along with adjustment of status application. Will she continue on her H4 status till she gets EAD/AP?
There are 2 ways in which current H4 status changes to AOS Pending status:
1. By working on employment using EAD
2. The primary applicant loses H1-B status for ANY reason
Please check and verify details with your attorney/lawyer. This is NOT a legal advice.

Many here are 'strongly against' those 'horrible' desi or whatever companies after getting an h1b through them. As we know most of the software consultants are here only because those companies could utlize the loopholes in the system. (We all know that this labor certification and such things are nonsense!). It is great to fight for 'legal' things but when you see those who misusd it themselves are 'fighting' for it, makes people feel so funny! We all know that what we all need is GC, whatever be the way, and whatever happens to 'others'. It is legitimate and understandable to fight for 'our cause', otherwise who will fight for us?
[According to me nothing is 'wrong' to be here using any method even being an 'illegal immigant', but fortunately I am here in USA 'legally' and not using 'desi' or such companies]
