llc and s-corp are same for the situation you brought up... however, you gotta be mindful of the "corporate veil"... http://en.wikipedia.org/wiki/Piercing_the_corporate_veil trap... which can affect any company llc or corp... dont worry, there is nothing bad in it... just make sure that you keep real good records and separate business operations from personal...
further i doubt that s-corp or corp is a promotion over llc as your post seems to suggest...
anyway... your choice is not bad... and neither is mine...

I am not sure whether the same exists for corp or not. So I may be wrong regarding the low risk factor of LLC. But I always had the notion of starting any venture as an LLC and then moving on to a corp.

This is not even good for long term due to hefty financial charges of insurance companies, you would not know about this until you buy one ,my sincere advice would be do not even get into this crap in US. these guys rip you off.
As I mentioned before Prudential charged 70% premiums as a finance charge every month and only 30% went to savings. It would never make sense and do n't listen to people who never owned these products before.

In such situation...dont let the situatuion grow..you need to change your gruop/company and remind the manager that they need to stick to rules..be diplomatic.If you are diplomatic and sensible in dealing with such cases..you will come out a winner..

Also all said and done CIR still remains a controversial bill, that at the very least has to be debated at length in the house to send out the right signals. If it gets passed in the lame duck, the conservatives will go to town with their story that an amnesty has been shoved down the throats of the american middle class. I doubt either the president or the democrats want that at this stage.

I don' think they should have been rude. However they do have a point. He should NOT have shown BOTH H1b visa and AP. You can enter on one or the other.
I have entered on AP previously and my experience was very good. Only thing is you have to undergo that "secondary inspection" process where they have to verify your pending status details.
When you hand them both, you might feel you are doing it in full disclosure,
however they perceive you are not clear in your intentions. When you show them your AP, their main verification is, whether this 485 case is still open and pending. With H1b they want to know if you are working for your visa petitioning employer.
The morale of the story is, if you have availed yourself of AC21 and moved into another job, you must use AP to reenter, either that or if you moved with a H1 transfer you can use that, however, presenting your old H1b is asking for trouble. H1b is employer specific. We always need to remember that. AP is not.
I intend to travel to my home country I have H1 (not stamped but valid till 2010) working for the same sponsor if I use AP to enter US do I lose my H1 status.I have EAD but did not use it.

kudos to what u accomplished in July 2007, but the reality is we haven't seen any major action after that. I guess its mostly frustration from ppl here, who think that the US housing/EB crisis can be pursued aggressively than expecting for CIR to happen.

5. Last of all, all the recaptured numbers should go to the persons based on the very first Port Of Entry date with continuous status. It doesn’t matter whether you came on F1 went to H1 then H4. The very first POE date should rule and people that have been languishing for years should get a reprieve. It’ll only be fair that a person that came on 1999 on whatever category gets a visa first than a late comer in 2005. PD is illogical since many of us had to change jobs and do what not and start afresh and still saw no light at the end of the tunnel.

I went thru TSC-EAC-TSC cycle. I did quite a bit of research online :) and found they did approve those cases, if PD is current. So, that shouldnt be a hurdle. Key is make sure you have all the checks are passed and current.

Yes, Its the same number, but at one of the prompts, you need to put a different number for LIN.
I just call them, was told that they have no additional information that what is available on the recorded message or the USCIS case status web site. I said I wanted to know if the case is 'pre-adjudicated' and the lady mentioned that that information is not disclosed. ;(

I am planning to file EAD/AP for my wife who is on H4 along with adjustment of status application. Will she continue on her H4 status till she gets EAD/AP?

Many here are 'strongly against' those 'horrible' desi or whatever companies after getting an h1b through them. As we know most of the software consultants are here only because those companies could utlize the loopholes in the system. (We all know that this labor certification and such things are nonsense!). It is great to fight for 'legal' things but when you see those who misusd it themselves are 'fighting' for it, makes people feel so funny! We all know that what we all need is GC, whatever be the way, and whatever happens to 'others'. It is legitimate and understandable to fight for 'our cause', otherwise who will fight for us?
[According to me nothing is 'wrong' to be here using any method even being an 'illegal immigant', but fortunately I am here in USA 'legally' and not using 'desi' or such companies]
